Description:
Building a consumer-facing digital health or wellness startup? Before you spend a dollar over-lawyering, get the lay of the land. This is a practical, founder-facing webinar for people who are just entering the space or about a year in and navigating compliance for the first time. It's a mini boot camp, not a lecture: real thresholds, plain-English rules, and where to spend your limited legal budget first.
We'll start by mapping what it actually means to handle health and consumer data. Not all "health" data is the same: some is covered by HIPAA, some is governed by state privacy laws like Washington's My Health My Data Act, and some sits outside both but still needs a real privacy policy and clear terms of use. We'll help you figure out where you fit in the ecosystem, whether you're rendering care, adjacent to it, or purely wellness, and which rules that actually trigger, so you don't over-promise, overspend, or claim to follow regulations you may not even be subject to.
For founders and operators building consumer-facing digital health, telehealth-adjacent, or wellness products, plus the early team members who own privacy, product, or growth.
Topics of Discussion:
We get concrete on the things founders tend to miss:
1. The thresholds that decide whether you're a covered entity, a vendor to one, or neither, and what changes at each level.
2. Consumer-facing agreements beyond the terms of use, including membership and purchase agreements, and being specific about what you're actually offering.
3. Marketing and tracking: how your analytics and ad tools interact with the data you collect, what a DPA and a BAA are, and why "the vendor's default settings" is not a defense when a regulator comes calling.
4. Using AI tools with health and consumer data, and the difference between a general model license and the special terms you need before you upload sensitive data.
5. You'll leave knowing how to prioritize, what to handle yourself, and how to work with counsel without torching your runway. No fear-mongering and no compliance theater.
Bring your questions. You can submit them when you register, and we'll work through as many as we can in a live Q&A.
